problem with top I bought

I bought a BCBG top on ebay that the seller said was new with tags, but the top has obviously been worn as it smells like someone's purfume.  Has this ever happened to any of you?  What should I do?  Should I contact the seller before leaving neutral/negative feedback?  I probably wouldn't have bid as much if I had known that the top wasn't new or wouldn't be dry cleaned before it was sent to me.

Did it actually have tags? Were there any other signs of wear? I was just wondering if it smelled like perfume because it was sandwiched in a closet with things with that perfume on them? Or if she squirted it to make it smell good - I had someone do this to something I bought - i thought it was incredibly tacky, but whatever....

Lol, Laken, that is so weird.  There were no tags and the top has definately been worn.  It is strapless and there are a couple of stains on the underarm area.

I would email them & tell them all those things: if it was misrepresented & won't refund your money or cooperate, report them to ebay - or you can try a resolution source - ebay uses squaretrade, although i've never had luck with them. Did you pay through paypal? I have filed 2 reports to paypal & both times they sided with me & i got my money back. I really think they err on the side of the buyer.
