overstock return policy question

Overstock's return policy is a little confusing to me. Basically, what I want to know is:  if I return something within 30 days that I opened and tried on and it does not fit , will they give me a refund of the full amt minus shipping charges and return shipping charges?  It sounds like they will penalize me and only give me a partial refund.  Is that how you read it?
Here is their policy:

We inspect all returned items when they arrive at our processing facility. We refund the full cost of the merchandise and all original shipping charges if your return is a result of our error or defective product.
If the return is not a result of our error and you initiate a return of an unopened item within 30 days of delivery,* we refund the full cost of the merchandise minus the original shipping charge and actual return shipping fees.

If you return an item that has been opened or shows signs of wear, we will issue a partial refund minus both original shipping charge and return shipping fees. Products decrease in value over time. Therefore, we reduce refunds for returns you initiate more than 30 days after delivery or received at our returns processing facility within 45 days.

I have returned a few items from Overstock, without any problems. Since it is within 30 days, and I assume the tags are still on, I'd return it and expect the full refund amount. You may choose the "item not as pictured" option instead of wrong fit, just in case they are strict on the reason for the return. I wouldn't count trying something on as having worn it.

I'd give the customer service a call or email if I was really worried about the policy. Email would also give you a paper trail if they do the refund differently than what was promised to you.
