i won a pair of shoes on ebay the other day after asking the seller countless questions regarding the fit and size and i had her measure the insole of the shoe for me. according to her measurement, the shoes fit. i recieved the shoes this week and they were way too small. i measured the insole myself and found that she had given me an incorrect measurement by 1/2 inch (that's what? at least a whole shoe size!) i sent her a very kind and carefully worded e.mail asking her if she's consider working with me on a return (she had an ALL SALES FINAL policy stated in her auction). she e.mailed me back this morning apologizing and kindly agreed to a refund. i thanked her and let her know that i would leave positive feedback for her once she recieved the shoes back and issued my refund. now i'm questioning if it's "safe" to return them to her. she didn't state a return policy in her auction, so i'll be screwed if i send the shoes back and she doesn't issue a refund, right? would i be screwed even if she DID state a return policy? it's $130.00 so it's sort of a big deal.
Keep printed copies of her authorization to return the shoes. THat is all the proof you need that she will accept a return in your situation. Also, return your shoes by a trackable shipping method to prove receipt of the return. Hopefully, you paid for the shoes on CC so if she doesn't return your money you can submit a request for a reversal of the charge to your CC company. I hope it all works out fot you.
Maybe if you sent with delivery confirmation you'd be sure she had received the item, so there would be no question there. Does she have good feedback?
thanks, girls. i feel better now. i plan on sending them priority mail, insured, with tracking/delivery confirmation. i paid for them with money that was already sitting in my paypal account — so i assume it's gone if she doesn't refund. she has good feedback. my only concern was that she has like 10,000 feedbacks, so what would one negative from me really do to her rating? nothing. she seems honest, i just wasn't sure if i'd be covered if anything happened. i'm gonna give it a shot though.
Hotcocoa - from other STers recent experiences selling via Paypal, it's pretty clear that they almost always side with the buyer. If she never gives you the refund, you'd probably have the money back within the week if you reported it to Paypal.
