my friend just told me they hired someone for my job; she started today... my job is protected until july 24 unless i have the baby before then, in which i go into FMLA and the job is protected for 13 more weeks.

it isn't a job where they need two people to do it or where they would hire a temp.... so i dont know what to do .. should i email my HR rep and ask her WTF is going on?

i am so sick of dealing with this bullshit

that is so messed up.  i would definitely speak with someone in HR.  how does your friend know that someone was hired?

we work in the same dept.
i got an email back from HR:

A new forecasting analyst has joined the P/A team. She is a new hire
into a budgeted open position. She is not replacement.
She will be helping with the Seasonal workload in your absence.


I think this is BS and she WILL replace me once my 90 day review stuff goes down.

Ouch, but hey, they've been doing things like this for a while so at least it's not a shock. Sorry to hear it - this must be really frustrating. Personally, I would email the HR rep something VERY polite (because you may see it again in mediation or court) just to make her say SOMETHING in writing. And then I'd hire a lawyer. Actually, first hire the lawyer before you put anything in writing. Does your contract mandate mediation? How much do you have documented? Good luck.


Oh, and because I've seen this happen before, please know that it will NOT have much of a long term impact on your career. Anyone you would want to work for knows how people get screwed in today's corporate environment. And the company won't be able to say anything about you, plus you have the difficult pregnancy which anyone would see as a reason to leave this job.


I really hope things go very well for you - seriously, everyone I know who's been through something like this came out just fine in the end. Usually everyone knows what's really going on. And they may not be able to do anything about it, but they won't hold it against the person who's getting screwed the way it might feel when you're, um, the person getting screwed.

wow.  admittedly i don't know much about this kind of situation at all, but i just want to express my solidarity with you, so to speak.  they're being so wrong, and that email from HR sounded pretty snotty to me.  i hope you will find a better job with more understanding people if that's what it comes too.


good luck!  you'll come through this okay, and someday it will be a distant memory after you've moved on to something better.

I think once again they are trying to pull some crap.However I don't think that you should act on it just yet, because you are still on leave.If you should, they may let the girl go as soon as you return and if you have the attorney and/or mediation ball rolling they may try to paint this picture that you don't know what you're talking about and that you make hasty decisions.Try to stay calm for the little ones and cross the bridge when you get to it.


Things will work out in your favor!

i agree.  i would make sure to get a paper trail.  and try not to let the hormones do the talking, as much as they should and you want them to.

By the way,do tell give us the 411 on that other job!I hope that you'll eventually get it (if you still want it)Just by the way the guy was very understanding about your pregnancy he seems like he would be good to work for.

No word on that other job... I contacted the guy twice and no answer.. so whateva!


As far as my current job, it looks like they are going to be switching my position... oh god... i cant wait to go back!
