Ok, what should I do? I won a pair of shoes that were listed as "new, never worn". When I received them, there was a small scuff-like rip in the right insole. So I wrote the seller saying that I did not think they were never worn because of this rip. She offered to refund my money and shipping if I returned the shoes. I paid to have them sent back.
The seller contacted me and said that there was not a rip in the shoes. I of course wrote back with more specifics of the rip. (The rip was inside the shoe, and could only be seen if you look into the shoe.) Now the seller wrote back and said that because there was not a rip, they were not refunding me and not sending me the shoes back! So now I paid the cost of the shoes + the initial shipping + my return shipping for a pair of shoes that I do not even have!
How should I respond to this? Please help! I am very frustrated!!!
1st: How did you pay for this? CC I hope. If you paid by CC (even if through Paypal) report it to your CC company and get a stop payment on this transaction and explain to them you paid and you don't have the merchandise. They won't pay it then.
2nd: I would complain to ebay that you sent them back and you don't have your money back so you should get either one or the other: the shoes back or the money. Did you take any pictures of the shoes while you had them?
No, I didn't take any pictures....which is very unfortunate! But, the tear was deep inside the shoe, so I am not sure if a picture would have even worked.
Should I file a complaint through ebay? Should I email the seller back? Here is the latest email I have received:
"HI TARA NOT SURE WHAT YOU WANT ME TO DO~THERE'S NO TEAR IN THE SHOES~YOU BID ON THE SHOES AND WON~NOW YOU ARE SAYING THERE IS A TEAR IN THE FOOTBED WHEN THERE IS NOT~SORRY WE WON'T BE ABLE TO REFUND YOU ON THE SHOES"
well would you keep the shoes and wear them if you had them? if so then ask for them back. if not email ebay and complain. How did you pay for them originally??

I knew this had to happen - I have been just too lucky with ebay! I am going to email the seller and threaten to file a formal complaint. Maybe that will help.
hmm then ask for the shoes back and maybe get them resoled by a cobbler. they can't keep your money and the shoes. You have to get one or the other back. I would threaten to turn them into ebay and see if they will give the shoes back or the money back.
Her FB rating is great....99.6% with 2935 FBs......This is what I wrote back to her....I hope it isn't too mean. What do you guys think?

I do not see how you can possibly think it is fair to keep the shoes AND refuse to refund my money. It was obvious to me and everyone that I showed the shoes to that they were not "new without box" as indicated in the auction. They were definitely used, as evidenced with the tear in the right shoe. This falls within the "Significantly not as described" section of the ebay dispute criteria.
If you prefer that I file a formal dispute via ebay, that is not a problem. However, if you want to avoid this, you can simply refund my money. I think this would be the best solution for both of us. If you were to send me the shoes back, you would be responsible for the shipping. Thus, if you refund my money, you can simply relist the shoes as used.
Considering the "power seller" that you are, I am baffled that you are being so difficult with the small amount I won the shoes for.
Please let me know how you want to move foward. I hope we can resolve this as soon as possible.

I think this letter is perfect. What a ridiculous situation! It would almost sound like some kind of scam if it wasn't for the good feedback.
You have to remember with eBay feedback, though, that people often don't leave a negative when it's deserved because they know they'll just get one back. I have done that before. I think that there are a lot of negative feedbacks that go unleft.
Hopefully this seller sorts it out properly.
