It does stick out slightly to the right when it is in the resting position.  However, it is not like it hits anything or gets in the way.  I never even noticed one windshield wiper was different than the other.

They said it was unsafe because if you can't see out of your windshield you can't drive safely.  I can see out of my windshield just fine!  If anything, the longer windshield wiper cleans MORE of the windshield than it should.

In NJ, you don't have to pay for inspection (unless you get it done at a mechanic who is usually easier on passing people).  If you go to the ones ran by the Motor Vehicle Commission, it's free.  I am still pissed that I have to pay for new wipers though.  I wish I remembered where I got my current wipers so I could tell them they used the wrong ones and maybe they would have to replace it for free.  However, I think I probably had it done on the DL for free when I worked part-time at Saturn.  In that case, there's not much I can do.
